On Wednesday, 28 January 2026, the Legal Affairs Committee of the European Parliament voted in favour of adopting the report by MEP Axel Voss on AI and copyright.

The Axel Voss report on artificial intelligence and copyright marks several important advances for the protection of works and rights holders in the era of generative AI. It clearly reaffirms the fundamental principles of copyright, in particular compliance with the Berne Convention, the three-step test and the principle of territoriality.
It emphasises that the training of AI models must be based exclusively on lawful and non-pirated data, and insists on the need for greater transparency regarding the sources and methods used to train AI systems.
The report also recognises the inadequacy of the current framework in relation to the uses of AI and calls for the creation of a genuine licensing market, based on voluntary licences and respectful of exclusive rights.
It supports the development of opt-out tools at European level, without calling into question the choices already made by rights holders at local level, and strengthens transparency requirements, particularly with regard to suppliers of general-purpose AI models.
Finally, this report proposes a rebuttable presumption of use of copyright-protected data in the event of non-compliance with transparency obligations by generative AI providers and AI systems.
This proposal partially answers to the industry’s requests to regain room for manoeuvre in negotiating licensing agreements with generative AI companies.
